Welcome to K-Scale Labs! These Terms of Service (“Terms”) govern your access to and use of our website, platform, services, and products (collectively, the “Services”). By using or accessing K-Scale Labs, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use our Services.

1. User Accounts

Account Creation: To access certain features, you need to create an account. You are responsible for maintaining the security of your account credentials. dpsh Syndicate DBA K-Scale Labs is not liable for any loss or damage arising from unauthorized access to your account.

Account Responsibility: You are responsible for all activity that occurs under your account.

2. User-Generated Content

Ownership: You retain ownership of any content you upload to the platform, including but not limited to K-Lang programs, robot builds, kernel images, URDF files, and machine learning models (“User Content”).

License to K-Scale Labs: By uploading User Content, you grant K-Scale Labs a non-exclusive, worldwide, royalty-free, and transferable license to use, host, store, reproduce, distribute, communicate, and display your content as part of the platform and Services.

Content Guidelines: You agree that your content will comply with our Acceptable Use Policy (see Section 6) and will not violate any applicable law, infringe on the rights of others, or contain malicious code.

3. Intellectual Property

K-Scale Labs Property: K-Scale Labs retains all rights to its trademarks, logos, and proprietary content, including but not limited to K-Lang, kernel images, documentation, and software (the “K-Scale Labs Content”). You may not use our trademarks or copyrighted materials without our prior written consent.

Licensing of Resources: User Content shared on the platform may be subject to an open-source license, such as MIT or GPL, as specified by the user who uploaded the content. Ensure you understand and comply with the licensing terms when using content from the platform.

4. Payments and Transactions

Purchasing Products: If you purchase robots or other products from K-Scale Labs, you agree to provide accurate payment information and authorize us to charge your payment method. All sales are subject to our Return and Refund Policy.

Subscriptions: For any subscription-based services or premium features, you agree to pay the specified fees and understand that failure to do so may result in termination of access to those services.

5. Privacy and Data Protection

Personal Data: Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

Third-Party Sharing: We may share your data with trusted third parties for purposes such as analytics or payment processing. By using our Services, you consent to this sharing, as described in the Privacy Policy.

6. Acceptable Use Policy

You agree to use our Services in a manner that is lawful and respectful of others. Specifically, you agree not to:

• Upload or share content that is illegal, harmful, offensive, or violates the rights of others.

K-Scale Labs reserves the right to remove content or terminate accounts that violate these rules.

7. Content Moderation and Removal

Right to Moderate: dpsh Syndicate DBA K-Scale Labs reserves the right to review, edit, or remove any content that violates these Terms or the Acceptable Use Policy.

Takedown Procedures: If you believe content on the platform infringes your intellectual property or violates your rights, you may submit a complaint to support@kscale.dev. We will promptly investigate and take appropriate action.

8. No Warranty and Limitation of Liability

No Warranty: Our Services are provided “as is,” without any warranty of any kind, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We make no guarantees that the Services will be error-free or uninterrupted.

Limitation of Liability: To the fullest extent permitted by law, K-Scale Labs will not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Services, including damages related to loss of data, malfunctioning robots, or content inaccuracies.

9. Termination

Right to Terminate: We reserve the right to terminate or suspend your access to the platform at our discretion if you violate these Terms or engage in unlawful or harmful activities.

Effect of Termination: Upon termination of your account, you will no longer have access to your uploaded content, but we may retain a copy for legal purposes.

10. Amendments and Updates

Changes to Terms: K-Scale Labs reserves the right to modify or update these Terms at any time. We will notify you of significant changes by email or by posting a notice on the platform. Your continued use of the Services after changes are made constitutes acceptance of those changes.
